What if I'm walking on the beach in Lake Havasu and I'm cited for littering?
I'm a legal permanent resident of the United States. I got a job through an HB-1 visa working for a local Arizona company. I'm at Lake Havasu having a good time swimming and jet skiing. I accidently drop my cooler and all my stuff goes flying everywhere. A local police officer sees my mess and decides to ticket me for littering. He notices my funny accent. This gives him probable cause to ask me for my ID papers. Unfortunately, I'm wearing swim trunks and don't have my papers on me. They are locked in my truck but my wife went to the store. The officer decides to detain me. I spend thousands of dollars hiring a lawyer while spending several weeks in a detainment center - all because of littering. While I'm detained, I lose my job. Is this right?
Sounds more like an Act of God. Did you ever see Magnolia? sounds like your kind of film. Did your wife go to a store in another state? I don't know why a legal permanent resident would be working on an H1b visa though. If he has a green card, he's not using an H1b visa anymore. In reality, it sounds a great deal more like a hypothetical than a real story. You should be able to provide enough information that it would be possible to confirm with DHS, and your employer is supposed to keep a record of your social security number or other document you used to show you had authorization to work.
